A provider could request reconsideration within 48 hours, but the request would not pause the order, and it could seek judicial review in the US Court of Appeals for the District of Columbia Circuit.
Violations of the general requirements could carry civil penalties of up to $2 million per day. Failure to comply with an emergency order could carry penalties of up to $20 million per day. The bill would require the department to issue initial rules within 90 days of enactment and update the definitions of covered entities and technologies annually.
